Circuit judges may appoint the law clerks and secretaries they need. A law clerk is generally exempt from the specified civil-service leave provisions unless the appointing judge or a local court rule includes the clerk.
Circuit judges may appoint necessary law clerks and secretaries. A law clerk appointed under this section must be exempt from the provisions of subchapter I of chapter 63 of title 5, unless specifically included by the appointing judge or by local rule of court.
