30 U.S.C. § 28i — Failure to pay

If a claimant doesn't pay the claim maintenance fee or the location fee as required, they automatically forfeit — lose — their unpatented mining claim, mill site, or tunnel site. That claim then becomes null and void by operation of law.
This is one short, undivided provision.
Failing to pay the claim maintenance fee or the location fee, as required by sections 28f to 28l of this title, conclusively counts as a forfeiture of the claimant's unpatented mining claim, mill site, or tunnel site. That claim is then deemed null and void by operation of law — meaning it becomes invalid automatically, without any further step needed.
Failure to pay the claim maintenance fee or the location fee as required by sections 28f to 28l of this title shall conclusively constitute a forfeiture of the unpatented mining claim, mill or tunnel site by the claimant and the claim shall be deemed null and void by operation of law.
