This section defines terms used in the chapter about Federal domestic assistance information. It defines assistance, domestic assistance programs, formulas, and the officials and entities involved.
In this chapter: (1) “Administering office” means the lowest agency unit responsible for managing a domestic assistance program. (2) “Agency” has the meaning in section 551(1) of title 5; this section does not define it. (3) “Assistance” (A) means transferring anything valuable for a public-support or stimulation purpose authorized by United States law, including (i) financial assistance, (ii) Government facilities, services, and property, and (iii) expert and technical information; but (B) does not include ordinary public information services or buying property or services for the Government’s direct benefit or use. (4) “Domestic assistance program” (A) means agency assistance for (i) a State, (ii) the District of Columbia, (iii) a United States territory or possession, (iv) a county, (v) a city, (vi) a political subdivision or instrumentality of one of those governmental authorities, (vii) a domestic corporation, (viii) a domestic institution, or (ix) a United States individual; and (B) does not include agency assistance for another agency. (5) “Director” means the Director of the Office of Management and Budget. (6) “Administrator” means the Administrator of General Services. (7) “Formula” means a required method using objective data or statistical estimates to decide among Federal-fund recipients, whether for eligibility or funding allocation. It must be expressible as (A) a closed mathematical statement or (B) an iterative procedure or algorithm that can be written as a computer program, and qualified people applying it independently must be able to reproduce its results within reasonable rounding limits.
