A National Guard member can't be ordered across a state line for duty paid with private money. This applies whether the duty is under this title or title 10. The only exception is duty responding to a major disaster or emergency under the Stafford Act.
A National Guard member can't be ordered to cross a state border to perform duty — whether under this title (Title 32) or under title 10 — if that duty is paid for with private funds. The only exception is duty performed in response to a major disaster or emergency declared under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. § 5170).
A member of the National Guard may not be ordered to cross a border of a State to perform duty (under this title or title 10) if such duty is paid for with private funds, unless such duty is in response to a major disaster or emergency under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5170).
