in plain englishAI-generated · not legal advice

The Secretaries of the Army and Air Force may provide National Guard units with supplies needed for field duty and may allow certain funds to buy issued articles. New types of equipment may be issued without charge, but the jurisdiction must protect and care for issued property.

(a) Under regulations the President sets, the Secretary of the Army and Secretary of the Air Force may buy or make supplies and, when the Governor of a State, Puerto Rico, Guam, or the Virgin Islands, or the commanding general of the District of Columbia National Guard, requests them, issue supplies needed to uniform, arm, and equip that jurisdiction’s Army National Guard or Air National Guard for field duty.

(b) If the responsible Secretary is satisfied that a State or Territory’s, Puerto Rico’s, or the District of Columbia’s Army or Air National Guard is properly organized, armed, and equipped for field duty, money allotted to that jurisdiction for its Army or Air National Guard may be used to buy any article that the Army or Air Force issues.

(c) Under the President’s regulations, issuing new types of equipment, small arms, or field guns to the National Guard of a State or Territory, Puerto Rico, or the District of Columbia does not count against National Guard appropriations.

(d) Property may not be issued to such a National Guard unless the jurisdiction makes arrangements satisfactory to the responsible Secretary for protecting and caring for it.
