32 U.S.C. § 711 — Disposition of obsolete or condemned property

When a listed jurisdiction’s National Guard receives new property replacing obsolete or condemned property, it must return the replaced property or dispose of it as the responsible Secretary directs. No credit is allowed for property disposed of under this section.
When a State, Puerto Rico, the District of Columbia, Guam, or the Virgin Islands receives new property for its National Guard to replace obsolete or condemned property, it must return the replaced property to the Department of the Army or Air Force, as appropriate, or otherwise dispose of it as the responsible Secretary directs. No money credit may be allowed for property disposed of under this section.
Each State, the Commonwealth of Puerto Rico, the District of Columbia, Guam, and the Virgin Islands shall, upon receiving new property issued to its National Guard to replace obsolete or condemned issues of property, return the replaced property to the Department of the Army or the Department of the Air Force, as the case may be, or otherwise dispose of it, as the Secretary concerned directs. No money credit may be allowed for property disposed of under this section.
