The Secretary may agree to pay operation and maintenance costs of an alternative to maintenance dredging when the combined cost is lower than maintaining the Federal navigation channel without the alternative.
The Secretary may agree to take on operation and maintenance costs for an alternative project instead of maintaining a Federal navigation channel by dredging if the alternative’s costs plus any remaining channel-maintenance costs are less than the cost of maintaining the channel without the alternative. This section does not define “alternative project” or “maintenance dredging.”
The Secretary may enter into agreements to assume the operation and maintenance costs of an alternative project to maintenance dredging for a Federal navigation channel if the costs of the operation and maintenance of the alternative project, and any remaining costs necessary for maintaining the Federal navigation channel, are less than the costs of maintaining such channel without the alternative project.
