This section deals with the Benton Harbor Canal in the city of Benton Harbor, Michigan. It covers the part of the canal that runs from the west line of Ninth Street (extended north) to the west line of Riverview Drive (extended north). The law declares that this stretch of the canal is not a "navigable water of the United States" under the Constitution and federal law. That means this part of the canal no longer counts as the kind of waterway that triggers certain federal rules and protections that apply to navigable waters.
The Benton Harbor Canal, from the west line of Ninth Street extended northerly to the west line of Riverview Drive extended northerly in the city of Benton Harbor and State of Michigan, be, and the same is hereby, declared to be not a navigable water of the United States within the meaning of the Constitution and laws of the United States.
