37 U.S.C. § 463 — Programs of compliance; electronic processing of travel claims
submitted 15 years ago by Pub. L. 112-81 to r/title-37-PAY-AND-ALLOWANCES-OF-THE-UNIFORMED-SERVICES · 242 words · no verdicts yet
The military must run compliance programs to catch inaccurate, unauthorized, inflated, or duplicate travel claims, mainly through near-real-time electronic checking. Within five years of a 2011 defense law, travel claims generally had to be processed electronically, though the Secretary could waive that for individual claims.
(a) Programs of compliance. The Secretaries who administer this chapter must set up and run compliance programs to make sure travel benefits are paid correctly.
(b) Elements. These compliance programs must: cut down on paying benefits based on inaccurate, unauthorized, inflated, or duplicate claims, mainly by verifying travel claims electronically on a near-real-time basis (plus whatever other methods the Secretaries set up); and make sure benefits never exceed the traveler's reasonable, actual, and necessary travel expenses, or reasonable allowances based on commercial travel rates.
(c) Electronic processing of travel claims. (1) Within five years of the National Defense Authorization Act for Fiscal Year 2012 being enacted, every travel claim under this chapter had to be processed electronically. (2) The Secretary, or someone the Secretary designates, can waive this electronic-processing requirement for a particular claim, if it serves the department's interests. (3) This electronic processing must follow the regulations the Secretary of Defense writes under section 464, applied the same way across all uniformed-service members and, as much as practical, all other authorized travelers.
The administering Secretaries shall provide for compliance with the requirements of this chapter through programs of compliance established and maintained for that purpose.
The programs of compliance under subsection (a) shall—
minimize the provision of benefits under this chapter based on inaccurate claims, unauthorized claims, overstated or inflated claims, and multiple claims for the same benefits through the electronic verification of travel claims on a near-time basis and such other means as the administering Secretaries may establish for purposes of the programs of compliance; and
ensure that benefits provided under this chapter do not exceed reasonable or actual and necessary expenses of travel claimed or reasonable allowances based on commercial travel rates.
By not later than the date that is five years after the date of the enactment of the National Defense Authorization Act for Fiscal Year 2012, any travel claim under this chapter shall be processed electronically.
The administering Secretary, or the Secretary’s designee, may waive the requirement in paragraph (1) with respect to a particular claim in the interests of the department concerned.
The electronic processing of claims under this subsection shall be subject to the regulations prescribed by the Secretary of Defense under section 464 of this title which shall apply uniformly to all members of the uniformed services* and, to the extent practicable, to all other authorized travelers.
