38 U.S.C. § 312A — Director of Construction and Facilities Management

(a) In General. (1) The Department has a Director of Construction and Facilities Management, appointed by the Secretary. (2) This job is a "career reserved position," as defined in title 5, section 3132(a)(8). (3) The Director gives direct support to the Secretary on the matters listed in subsection (c). (4) For those matters, the Director reports to the Deputy Secretary. (b) Qualifications. Each person appointed Director must: (1) hold an undergraduate or master's degree in architectural design or engineering; and (2) have real, substantial professional experience managing construction projects. (c) Responsibilities. (1) The Director must (A) be responsible for overseeing and managing the planning, design, construction, and operation of Department facilities and infrastructure, including major and minor construction projects; and (B) perform other functions the Secretary assigns. (2) In carrying out that oversight and management, the Director is responsible for: (A) developing and updating short-range and long-range strategic capital investment strategies and plans for the Department; (B) planning, designing, and constructing Department facilities, including setting architectural and engineering requirements and making sure the Department follows the laws that apply to its construction program; (C) managing the Department's short-term and long-term leasing of real property; (D) repair and maintenance of Department facilities, including custodial services, building management and administration, and maintaining roads, grounds, and infrastructure; and (E) managing procurement and acquisition for building and operating Department facilities, including awarding contracts for design, construction, furnishing, and supplies and equipment.
