39 U.S.C. § 205Procedures of the Board of Governors

submitted 56 years ago by Pub. L. 91-375 to r/title-39-POSTAL-SERVICE · 218 words · no verdicts yet

The Postal Service's Board of Governors directs spending and reviews policy. Six members present form a quorum for most votes, though appointing top officers needs more. No U.S. officer or employee can also serve as a Governor.

(a) The Board directs and controls the Postal Service's spending, and reviews its practices and policies. It also performs whatever other duties this title assigns it. (b) If seats on the Board are vacant, that doesn't weaken the Board's power — as long as enough members remain to form a quorum. (c) The Board acts by majority vote of the members present. Normally, any 6 members present form a quorum for doing business. But there are exceptions: appointing or removing the Postmaster General, and setting the pay of the Postmaster General and Deputy Postmaster General, requires a favorable vote from an absolute majority of all sitting Governors. Appointing or removing the Deputy Postmaster General requires a favorable vote from an absolute majority of sitting Governors plus the member serving as Postmaster General. Other parts of this title may set their own different rules. (d) No U.S. government officer or employee can serve as a Governor at the same time. A Governor can hold another job or office, as long as it doesn't conflict with their duties and powers as a Governor of the Postal Service.

The Board shall direct and control the expenditures and review the practices and policies of the Postal Service, and perform other functions and duties prescribed by this title.

(b)

Vacancies in the Board, as long as there are sufficient members to form a quorum, shall not impair the powers of the Board under this title.

(c)

The Board shall act upon majority vote of those members who are present, and any 6 members present shall constitute a quorum for the transaction of business by the Board, except—

(1)

that in the appointment or removal of the Postmaster General, and in setting the compensation of the Postmaster General and Deputy Postmaster General, a favorable vote of an absolute majority of the Governors in office shall be required;

(2)

that in the appointment or removal of the Deputy Postmaster General, a favorable vote of an absolute majority of the Governors in office and the member serving as Postmaster General shall be required; and

(3)

as otherwise provided in this title.

(d)

No officer or employee of the United States may serve concurrently as a Governor. A Governor may hold any other office or employment not inconsistent or in conflict with his duties, responsibilities, and powers as an officer of the Government of the United States in the Postal Service.
