39 U.S.C. § 502 — Commissioners

submitted 20 years ago by Pub. L. 109-435 to r/title-39-POSTAL-SERVICE · 237 words · no verdicts yet

in plain englishAI-generated · not legal advice

This law sets up the 5-member Postal Regulatory Commission, appointed by the President with Senate approval, chosen for expertise rather than politics. It limits how many members can share a political party, bars financial ties to private mail-delivery businesses, and sets 6-year terms with a Chairman and Vice Chairman.

(a) The Postal Regulatory Commission is made up of 5 Commissioners, appointed by the President with the Senate's approval. They must be chosen solely for their technical qualifications, professional standing, and demonstrated expertise in economics, accounting, law, or public administration, and the President may remove them only for cause. Each Commissioner must have the qualifications and expertise needed to carry out the enhanced responsibilities given to Commissioners under the Postal Accountability and Enhancement Act. No more than 3 Commissioners may belong to the same political party.

(b) No Commissioner may have a financial interest in any private-sector business that delivers mail.

(c) A Commissioner may keep serving after their term expires until a successor is confirmed, but never for more than 1 year past when the term would otherwise expire under subsection (f).

(d) One Commissioner is designated Chairman by the President, and serves as Chairman at the President's pleasure.

(e) The Commissioners choose a Vice Chairman among themselves by majority vote. The Vice Chairman acts as Chairman whenever the Chairman is absent.

(f) Commissioners serve 6-year terms.
