40 U.S.C. § 17308 — Presumption of lawful conduct

For shipments covered by the regulations, an officer, employee, or authorized individual who acts in good faith and substantially follows them is presumed to have properly performed official duties. The presumption also covers the person’s bond and oath conditions.
For deciding whether an act or omission related to a regulated shipment* was proper, an officer or employee of the Federal Government, or an individual acting for a wholly owned Government corporation*, who makes the shipment in good faith and substantially follows the regulations is considered to be faithfully carrying out official duties and fully performing the conditions of the person’s bond and oath of office.
For purposes of the propriety of an act or omission related to a shipment* to which the regulations prescribed under section 17302 of this title apply, every officer and employee of the Federal Government and every individual acting on behalf of a wholly owned Government corporation* who makes a shipment of valuables* in good faith under, and substantially in accordance with, the regulations is deemed to be acting in the faithful execution of the officer’s, employee’s, or individual’s duties of office and in full performance of any conditions of the officer’s, employee’s, or individual’s bond and oath of office.
