This chapter never forces a federal agency to build or modify power facilities for non-federal buyers. Money from electricity sales can fund fuel, operation, and maintenance costs without a yearly deadline. Each agency head negotiates and signs its own contracts to sell or buy electric energy.
(a) Accommodation of needs for electric energy. This chapter does not require or allow a federal agency* to build a new power generating facility or related facility, modify an existing one, or use reserve or standby equipment to meet a non-federal person's need for electric energy.
(b) Availability of revenue from sales. Money a federal agency gets under section 17902 of this title from selling electric energy generated at its own facility can be used by that agency, with no fiscal-year deadline, to buy fuel and to pay for operation, maintenance, and other costs of that facility.
(c) Exercise of authorities. The authority under this chapter must be used for whatever time periods and on whatever terms and conditions the head of the federal agency decides are necessary, consistent with: (1) this chapter; and (2) the agency head's other legal responsibilities.
(d) Negotiation and execution of contracts and other agreements. The head of the federal agency that is selling or buying electric energy under this chapter must negotiate and sign any contract or agreement made under this chapter.
This chapter does not require or authorize a federal agency* to construct a new electric generating facility or related facility, to modify an existing facility, or to employ reserve or standby equipment to accommodate the needs of a non-federal person* for electric energy.
Revenue received by a federal agency pursuant to section 17902 of this title from the sale of electric energy generated from a facility of that agency is available to the agency without fiscal year limitation to purchase fuel and for operation, maintenance, and other costs associated with that facility.
The authority under this chapter shall be exercised for those periods and pursuant to terms and conditions that the head of the federal agency concerned decides are necessary consistent with—
this chapter; and
responsibilities of the head of the federal agency under other law.
A contract or other agreement executed under this chapter shall be negotiated and executed by the head of the federal agency selling or purchasing electric energy under this chapter.
