41 U.S.C. § 4502 — Payment

This section says how payments under section 4501 should be measured and limits them to the unpaid contract price.
(a) When practicable, payments under section 4501 must be based on: (1) performance measured objectively and quantitatively, such as acceptable deliveries, work measurement, or statistical process controls; (2) completion of events defined in the program management plan; or (3) other quantitative results. (b) A payment under section 4501 may not exceed the unpaid contract price.
When practicable, payments under section 4501 of this title shall be made on any of the following bases:
Performance measured by objective, quantifiable methods such as delivery of acceptable items, work measurement, or statistical process controls.
Accomplishment of events defined in the program management plan.
Other quantifiable measures of results.
Payments made under section 4501 of this title may not exceed the unpaid contract price.
