41 U.S.C. § 8706 — Civil actions

This section allows the Federal Government to recover civil penalties for kickbacks and sets a six-year limitations period.
(a) In a civil action, the Government may recover from a person* who knowingly engages in section 8702 conduct a penalty equal to twice each kickback* plus up to $10,000 for each occurrence. If the person’s employee, subcontractor*, or subcontractor employee* gives, accepts, or charges the kickback, the penalty equals the kickback amount.
(b) The action must be filed within six years after the later of the date of the prohibited conduct or the date the Government knew or reasonably should have known it occurred.
The Federal Government in a civil action may recover from a person*—
that knowingly engages in conduct prohibited by section 8702 of this title a civil penalty equal to—
twice the amount of each kickback* involved in the violation; and
not more than $10,000 for each occurrence of prohibited conduct; and
whose employee, subcontractor*, or subcontractor employee* violates section 8702 of this title by providing, accepting, or charging a kickback a civil penalty equal to the amount of that kickback.
A civil action under this section must be brought within 6 years after the later of the date on which—
the prohibited conduct establishing the cause of action occurred; or
the Federal Government first knew or should reasonably have known that the prohibited conduct had occurred.
