42 U.S.C. § 17021 — Biomass-based diesel and biodiesel labeling

(a) In general. Every retail diesel pump must carry a label telling customers what percent of the fuel is biomass-based diesel or biodiesel, in whatever form the Federal Trade Commission requires. (b) Labeling requirements. By June 16, 2008, the Federal Trade Commission must issue labeling rules: (1) A blend with 5 percent or less biomass-based diesel or biodiesel, that also meets the ASTM D975 diesel standard, needs no extra label. (2) A blend with more than 5 percent but not more than 20 percent must be labeled "contains biomass-based diesel or biodiesel in quantities between 5 percent and 20 percent." (3) A blend with more than 20 percent must be labeled "contains more than 20 percent biomass-based diesel or biodiesel." (c) Definitions. (1) "ASTM" means the American Society of Testing and Materials. (2) "Biomass-based diesel" has the same meaning as "biodiesel" in section 13220(f) of this title. (3) "Biodiesel" means monoalkyl esters made from long-chain fatty acids in plants or animals, that meet (A) this section's fuel-registration requirements and (B) the ASTM D6751 standard. (4) A "biomass-based diesel blend" or "biodiesel blend" means biomass-based diesel or biodiesel mixed with regular petroleum diesel.
