The Energy Information Administration and EPA must share commercial-building energy data under a written agreement submitted to Congress.
(a) “Administrator” means the Energy Information Administration Administrator. “Agreement” means the agreement under subsection (b). “Survey” means the Commercial Building Energy Consumption Survey. (b) Within 120 days after November 15, 2021, the two Administrators must sign and submit to Congress an agreement about commercial-building energy-consumption data. (c) To the extent law permits, the agreement must give the EIA Administrator access to building-specific EPA Portfolio Manager data and the EPA Administrator access to building-specific Survey data. It must explain how the EIA Administrator will use the data; compare the EIA, EPA, and State* and local methods for making Survey, Portfolio Manager, and disclosure-law data reliable and accurate and how to improve them; compare matching-building data from the 2018 and later Survey cycles with Portfolio Manager data; and consider whether and how the EIA Administrator could publish new Survey data every 3 years using EIA processes, with or without Portfolio Manager information. (d) The data includes Portfolio Manager data, data that State or local disclosure laws require to be public online, and information about private buildings of at least 250,000 square feet. (e) The Administrators must protect information under 5 U.S.C. §552(b)(4), subchapter III of title 44 chapter 35, and other applicable law and regulations.
