42 U.S.C. § 1962–4 — Implementation of water resources principles and requirements

(a) Within 180 days after December 27, 2020, the Secretary^* must issue final agency-specific procedures needed to implement the principles and requirements and the interagency guidelines. (b) The procedures must ensure that, when forming future water-resources projects, the Secretary develops them under the guiding principles and the national policy in 42 U.S.C. § 1962–3(a), and fully identifies and analyzes national economic-development benefits, regional economic-development benefits, environmental-quality benefits, and other societal effects. (c) Every five years the Secretary must review and, when appropriate, revise the procedures. (d) When issuing, reviewing, or revising them, the Secretary must notify interested non-Federal stakeholders of an intent to revise, give them opportunities to engage and provide input and recommendations, and request and consider public and expert comments. (e)(1) “Interagency guidelines” means the guidelines in the document finalized by the Council on Environmental Quality in December 2014 under 42 U.S.C. § 1962–3 to implement the principles and requirements. (2) “Principles and requirements” means the principles and requirements in the Council on Environmental Quality document titled “Principles and Requirements for Federal Investments in Water Resources,” dated March 2013, prepared under 42 U.S.C. § 1962–3.
