This section gives each river basin commission powers for carrying out the subchapter. It also sets rules for oaths, public inspection of records, help from Federal agencies, and responsibility for the commission’s personnel and funds.
(a) Hearings, proceedings, evidence, reports; office space; use of mails; personnel, consultants, and professional service contracts; personnel from other agencies; retirement and employee benefit system for personnel without coverage; motor vehicles; necessary expenses; other powers. To carry out this subchapter, each river basin commission may— (1) hold hearings; meet and act at the times and places it chooses; take testimony; receive evidence; and print, reproduce, and distribute as much of its proceedings and reports about them as it considers advisable; (2) acquire, furnish, and equip the office space it needs; (3) use the United States mails in the same way and under the same conditions as United States departments and agencies; (4) employ and pay the personnel it considers advisable, including consultants. It may pay them at rates no higher than the daily equivalent of the rate set for grade GS–18 under section 5332 of title 5. It may also keep and pay professional or technical service firms under contracts, as it considers advisable; (5) arrange for the services of personnel from any State* or from the United States, or from any subdivision or agency of a State or the United States, or from any intergovernmental agency; (6) make arrangements, including contracts, with any participating government other than the United States or the District of Columbia to include in a suitable retirement and employee benefit system those of its personnel who may not be eligible for, or may not be continuing in, another governmental retirement or employee benefit system. The commission may instead provide this coverage for its personnel in another way; (7) purchase, rent, operate, and maintain passenger motor vehicles; and (8) incur the necessary expenses and use other powers that are consistent with, and reasonably needed to perform, its functions under this chapter. (b) Oaths. The chairman of a river basin commission, or a commission member whom the chairman designates for this purpose, may administer oaths when a majority of the commission determines that testimony will be taken or evidence will be received under oath. (c) Records; public inspection. To the extent permitted by law, each river basin commission must make all appropriate records and papers available for public inspection during ordinary office hours. (d) Information and personnel from other Federal agencies. When the chairman of a river basin commission, or a member or employee whom the chairman designates for this purpose, requests it, the head of any Federal department or agency may— (1) give the commission information that it needs to carry out its functions and that the department or agency has or can obtain; and (2) assign, on a reimbursable basis, personnel under that department head’s or agency head’s administrative authority to temporary duty with the commission if the commission needs them or believes they would be useful in carrying out its functions. Each assignment must be made without loss of seniority, pay, or other employee status. (e) Responsibility for personnel and funds. With the vice chairman’s agreement, the chairman of each river basin commission must appoint the commission’s employees. Consistent with the commission’s general policies about the work it must accomplish and when it must accomplish that work, the chairman is responsible for— (1) supervising the commission’s employees; (2) assigning duties and responsibilities among them; and (3) using and spending the funds available to the commission.
