42 U.S.C. § 242c–1 — Advisory committee to the Director

This section creates an advisory committee for the CDC Director. (a) In general. Within 60 days of December 29, 2022, the Secretary, acting through the CDC Director, must keep or create an advisory committee within the CDC to advise the Director on policy and strategy for fulfilling the agency's mission. (b) Functions and activities. The Advisory Committee may: (1) recommend how to prioritize CDC's activities in line with the CDC Strategic Plan; (2) advise on improving performance metrics tied to that Plan and other relevant measures; (3) advise on developing and updating the Plan; (4) advise on grants, cooperative agreements, contracts, or other transactions; (5) give the Director other advice, as requested, to help fulfill duties under sections 241 and 243; and (6) create subcommittees. (c) Membership. (1) The Committee has up to 15 non-federal members, including the Chair, appointed by the Secretary as described in (3). (2) Any ex officio members may include the Secretary, the Assistant Secretary for Health, the Director, and other federal officers or employees the Secretary decides are needed. (3) Appointed members: (A) twelve are picked by the Director from leading experts in fields like public health, global health, health disparities, biomedical research, and public health preparedness; (B) three may be picked by the Secretary from the general public, including leaders in innovation, public policy, public relations, law, economics, or management. (4) Ex officio federal members aren't paid for serving. Other members can be paid, for each day working on committee business (including travel time), up to the daily rate for Executive Schedule Level III. (5) Terms: (A) appointed members serve 4-year terms, except someone filling an unexpired vacancy serves only the rest of that term; the Secretary must stagger terms so they don't all expire the same year; a member may keep serving after their term ends until a successor is appointed. (B) A member who served a full 4-year term can't be reappointed for 2 years after that term ends. (C) If a vacancy opens among appointed members, the Secretary must fill it within 90 days. (d) Chair. The Secretary picks a Committee member — possibly from the appointed members — to chair the Committee, for a 2-year term. (e) Meetings. The Committee meets when the Chair calls a meeting or the Director requests one, but at least twice each fiscal year. (f) Executive secretary and staff. The Director must assign a staff member to serve as the Committee's executive secretary, and must give the Committee the staff, information, and other help it needs, including orientation and training for new members.
