submitted 82 years ago by Pub. L. 99-158 to r/title-42-THE-PUBLIC-HEALTH-AND-WELFARE · 202 words · no verdicts yet

in plain englishAI-generated · not legal advice

If the Secretary decides, after consulting NIH, the FDA, and the CDC, that a disease or disorder is a public health emergency, NIH's Director must speed up advisory-council and peer review of grant and contract proposals for research on it, can waive normal contract-advertising rules for such research, may boost existing grants or contracts to support new related research (by no more than half the original amount), and must share findings from that research with health professionals and the public.

If the Secretary decides, after consulting the Director of NIH, the Commissioner of the Food and Drug Administration, or the Director of the Centers for Disease Control and Prevention, that a disease or disorder is a public health emergency, then the Secretary, acting through the Director of NIH, must: (1) speed up the advisory-council review under section 284a of this title, and the peer-group review under section 289a of this title, of grant applications and contract proposals for research on that disease or disorder; (2) use the public-exigency authority in section 6101 of title 41 to waive the normal advertising requirements for contract proposals for that research; (3) may give existing grants and contracts administrative supplemental increases to support new research relevant to the disease or disorder; and (4) must share information developed through research funded under this section — on the disease or disorder's cause, prevention, and treatment — with health professionals and the public. Any supplemental increase given under (3) cannot be more than half the grant's or contract's original amount.
