Money set aside for emergency rooms can cover up to half the cost of building or upgrading a public or nonprofit hospital's emergency room, but only after consulting the state and only where the project meets regulatory criteria aimed at real, otherwise-unmet needs.

Money appropriated under section 291j–8 pays for Secretary-issued grants covering up to 50 percent of the cost of building or modernizing emergency rooms at public or nonprofit general hospitals, including the cost of providing or replacing medical transportation. The Secretary can only make these grants after consulting the state agency named under section 291d(a)(1). To qualify, both the project and the applicant must meet criteria set by regulation. Those regulations must be designed to give help only where adequate assistance isn't already reasonably available from other federal, state, local, or other sources, and to support modern, efficient, effective emergency room care for victims of highway, industrial, agricultural, or other accidents and other medical emergencies — especially in areas that have a special need for it.
