42 U.S.C. § 300ff–31b — Authorization of appropriations

(a) In general — Congress authorized specific dollar amounts for this subpart: $1,195,500,000 for fiscal year 2007, $1,239,500,000 for 2008, $1,285,200,000 for 2009, $1,349,460,000 for 2010, $1,416,933,000 for 2011, $1,487,780,000 for 2012, and $1,562,169,000 for 2013. Each year's money stays available for the Secretary to commit until the end of the second fiscal year after it, then it expires. (b) Reservation of amounts — Of whatever is appropriated for a fiscal year, the Secretary must first set aside $5,000,000 for the emerging-communities grants under section 300ff–30. Then, of any amount above the "2006 adjusted amount" — the 2006 appropriation under former section 300ff–77(b), not counting money set aside just for the ADAP drug program under section 300ff–26 — the Secretary must reserve one-third for supplemental grants under section 300ff–29a, subject to the hold-harmless rule in section 300ff–28(a)(2)(H), except that money appropriated only for the ADAP drug program itself is not subject to this one-third reservation.
