If an approved entry already has a patent, the Secretary of the Interior may cancel it and issue a new patent. The new patent goes to the entrant, heirs, or assigns.
When a patent has issued for an entry approved by the Secretary or a designated officer, the Secretary or officer may cancel it and issue a new patent on that approval to the person who made the entry, that person’s heirs, or assigns.
Where patents have been already issued on entries which are approved by the Secretary of the Interior, the Secretary of the Interior, or such officer as he may designate, upon the canceling of the outstanding patent, is authorized to issue a new patent, on such approval, to the person who made the entry, his heirs or assigns.
