43 U.S.C. § 316cAlteration of grazing districts

submitted 99 years ago by ch. 513 to r/title-43-PUBLIC-LANDS · 115 words · no verdicts yet

in plain englishAI-generated · not legal advice

Once a grazing district exists, the Secretary can still change its size. Land can be added or removed based on its grazing value. The Secretary can also agree to manage a private owner's nearby land as part of the district.

After a grazing district is created, its boundaries can still change in three ways. (1) The Secretary may add any public land to the district that, in the Secretary's opinion, belongs there. (2) The Secretary may also remove land from the district that the Secretary decides is no longer valuable for grazing, or is more valuable for some other purpose — but only subject to any lessee's existing rights on that land. (3) The Secretary may also make a cooperative agreement with a private landowner to manage that person's land, if it touches or sits next to the district, as if it were part of the district.

After any district is established the area embraced therein may be altered in any of the following ways:

(1)

The Secretary may add to such districts any public lands which, in his opinion, should be made a part of the district.

(2)

The Secretary, subject to existing rights of any lessee, may exclude from such district any lands which he determines are no longer valuable for grazing purposes or are more valuable for other purposes.

(3)

The Secretary may enter into cooperative agreement with any person, in respect of the administration, as a part of a district, of lands owned by such person which are contiguous or adjacent to such district or any part thereof.
