Anyone who lies about a vessel's identity to defraud someone, or fakes a vessel's ID number, can be fined and jailed for up to two years. People can also face a civil fine of up to $10,000 for giving false information or breaking related rules, and the government can seize the vessel. If a company breaks the rules, its top officer can be punished too.
(a) A person can be fined under title 18 and imprisoned for up to 2 years, or both, if — meaning to defraud someone — they: (1) give false vessel*-identification information to the Secretary of Transportation or a State* issuing authority; or (2) tamper with, remove, or fake the unique vessel ID number assigned under section 12502.
(b) A person owes the government a civil penalty of up to $10,000 if they: (1) give false vessel-identification information to the Secretary or a State issuing authority; (2) violate section 12502, the numbering and marking rules; or (3) fail to follow requirements the Secretary set under section 12505, the fees section.
(c) A vessel — and its equipment — that was involved in breaking this chapter's rules, or a regulation under it, can be seized and forfeited to the government.
(d) If the violator is a company or organization rather than an individual, its president or chief executive can also be punished under this section.
A person shall be fined under title 18, imprisoned for not more than 2 years, or both, if the person with the intent to defraud—
provides false information to the Secretary of Transportation or a State* issuing authority regarding the identification of a vessel* under this chapter; or
tampers with, removes, or falsifies the unique vessel identification number assigned to a vessel under section 12502 of this title.
A person is liable to the United States Government for a civil penalty of not more than $10,000 if the person—
provides false information to the Secretary or a State issuing authority regarding the identification of a vessel under this chapter;
violates section 12502 of this title; or
fails to comply with requirements prescribed by the Secretary under section 12505 of this title.
A vessel involved in a violation of this chapter, or regulation under this chapter, and its equipment, may be seized by, and forfeited to, the Government.
If a person, not an individual, is involved in a violation of this chapter, the president or chief executive of the person also is subject to any penalty provided under this section.
