The Secretary of Transportation can only charter a government vessel to a private operator through sealed competitive bidding. Bids must strictly follow the terms and conditions in the public advertisement. The advertisement must list the vessels offered, minimum sailings, charter length, and the Secretary's right to reject bids.
(a) In General. The Secretary of Transportation may charter a Department vessel* to a private operator only through competitive sealed bidding. Bids must strictly follow the terms and conditions stated in a public advertisement.
(b) Advertisement for Bids. The advertisement must state*: (1) the number, type, and tonnage of vessels offered for bareboat charter to run a steamship line on a named trade route; (2) the minimum number of sailings required; (3) how long the charter will last; (4) that the Secretary has the right to reject all bids; and (5) any other information the Secretary thinks bidders need.
(c) Opening of Bids. Bids must be opened at the time and place the advertisement states. Everyone interested, including the press, must be allowed to attend. The results must be announced publicly.
The Secretary of Transportation may charter a vessel* of the Department of Transportation to a private operator only on the basis of competitive sealed bidding. The bids must be submitted in strict compliance with the terms and conditions of a public advertisement soliciting the bids.
An advertisement for bids shall state*—
the number, type, and tonnage of the vessels being offered for bareboat charter for operation as a steamship line on a designated trade route;
the minimum number of sailings required;
the length of time of the charter;
the right of the Secretary to reject all bids; and
other information the Secretary considers necessary for the information of prospective bidders.
Bids required under this section shall be opened at the time and place stated in the advertisement for bids. All interested persons, including representatives of the press, shall be permitted to attend. The results of the bidding shall be publicly announced.
