The Secretary of Homeland Security must write and enforce rules on boarding an uninspected arriving vessel. Breaking these rules is a crime, with fines and up to 6 months in jail. This section adds to, and does not replace, section 2279 of title 18.
(a) Regulations. The Secretary of Homeland Security must write and enforce rules on boarding a vessel* that has arrived at a U.S. port before that vessel has been inspected and secured.
(b) Criminal Penalty. Anyone who violates a rule made under this section must be fined under title 18, imprisoned for up to 6 months, or both.
(c) Relationship to Other Law. This section supplements, rather than replaces, section 2279 of title 18.
The Secretary of Homeland Security shall prescribe and enforce regulations on the boarding of a vessel* arriving at a port of the United States before the vessel has been inspected and secured.
A person violating a regulation prescribed under this section shall be fined under title 18, imprisoned for not more than 6 months, or both.
This section shall be construed as supplementary to section 2279 of title 18.
