This law defines five terms for this chapter on shipping containers. "Container" and "safety approval plate" follow the meanings in the International Convention for Safe Containers. "International transport" covers moving a container to, from, or between countries outside the U.S.
This section defines five terms used in this chapter, about shipping container safety.
(1) Container. Has the meaning given in the Convention (the International Convention for Safe Containers).
(2) Convention. Means the International Convention for Safe Containers and its annexes, signed at Geneva, Switzerland, on December 2, 1972.
(3) International transport. Means moving a container either: (A) between a place in a foreign country and a place under U.S. jurisdiction; or (B) between two places outside the United States, when U.S. carriers do the moving.
(4) Owner. Includes a lessee (renter) or bailee (temporary holder) of a container, if a written lease or bailment agreement says that person takes on the owner's job of maintaining and examining the container.
(5) Safety approval plate. Has the meaning given in annex I of the Convention.
In this chapter:
The term “container” has the meaning given that term in the Convention.
The term “Convention” means the International Convention for Safe Containers, and its annexes, done at Geneva, Switzerland, December 2, 1972.
The term “international transport” means the transportation of a container between—
a place in a foreign country and a place in the jurisdiction of the United States; or
two places outside the United States by United States carriers.
The term “owner” includes the lessee or bailee of a container if a written lease or bailment provides for the lessee or bailee to exercise the owner’s responsibility for maintaining and examining the container.
The term “safety approval plate” has the meaning given that term in annex I of the Convention.
