46 U.S.C. § 8905 — Exemptions

This law creates exceptions to boat licensing and towing rules. A dealer demonstration boat only needs section 8903's license rule if the Secretary decides it's needed for safety. Oil spill response boats are excused from the towing-vessel rule. Alaska may also get a special exemption for small passenger boats.
(a) Section 8903's licensing requirement applies to a recreational vessel* used in dealer demonstrations only if the Secretary decides applying it is necessary for recreational vessel safety, under section 4302(d).
(b) Section 8904's towing-vessel operator-licensing requirement does not apply to an oil spill response vessel while it is doing oil spill response or training activities.
(c) After consulting with the Governor of Alaska and Alaska's state* boating law administrator, the Secretary may exempt someone operating a self-propelled uninspected passenger vessel from section 8903's requirements, if: (1) the person operates the vessel only within Alaska waters; and (2) the vessel is 26 feet or less long and carries no more than 6 passengers.
Section 8903 of this title applies to a recreational vessel* operated in dealer demonstrations only if the Secretary decides that the application of section 8903 is necessary for recreational vessel safety under section 4302(d) of this title.
Section 8904 of this title does not apply to an oil spill response vessel while engaged in oil spill response or training activities.
After consultation with the Governor of Alaska and the State* boating law administrator of Alaska, the Secretary may exempt an individual operating a self-propelled uninspected passenger vessel from the requirements of section 8903 of this title, if—
the individual only operates such vessel wholly within waters located in Alaska; and
such vessel is—
26 feet or less in length; and
carrying not more than 6 passengers.
