49 U.S.C. § 20163 — Certification of train conductors

The Secretary of Transportation must create rules to certify train conductors. Conductors must be trained under the standards in section 20162. The Secretary may also borrow requirements from section 20135(b) through (e).
(a) Regulations. Within 18 months after the Rail Safety Improvement Act of 2008, the Secretary of Transportation must issue rules setting up a program to certify train conductors. These rules must require conductors to be trained according to the standards created under section 20162.
(b) Program Requirements. While writing these rules, the Secretary may consider using the same kinds of requirements found in section 20135(b) through (e).
Not later than 18 months after the date of enactment of the Rail Safety Improvement Act of 2008, the Secretary of Transportation shall prescribe regulations to establish a program requiring the certification of train conductors. In prescribing such regulations, the Secretary shall require that train conductors be trained, in accordance with the training standards developed pursuant to section 20162.
In developing the regulations required by subsection (a), the Secretary may consider the requirements of section 20135(b) through (e).
