Most regulations under this chapter must follow title 5 section 553’s rulemaking procedure. The requirements in title 5 sections 556 and 557 do not apply.
The Secretary’s regulations carrying out this chapter, except section 31307, must be prescribed under section 553 of title 5 without applying sections 556 and 557 of title 5.
Regulations prescribed by the Secretary of Transportation to carry out this chapter (except section 31307) shall be prescribed under section 553 of title 5 without regard to sections 556 and 557 of title 5.
