49 U.S.C. § 44937 — Prohibition on transferring duties and powers

The TSA Administrator cannot hand off certain security duties to another federal agency. This covers specific screening, security, and investigation powers listed in the statute. Only another law can authorize such a transfer.
Unless another law specifically allows it, the Administrator of the Transportation Security Administration may not transfer to another department, agency, or instrumentality of the United States Government any duty or power under sections 44903(a), (b), (c), or (e), 44906, 44912, 44935, 44936, or 44938(b)(3) of this title.
Except as specifically provided by law, the Administrator of the Transportation Security Administration may not transfer a duty or power under section 44903(a), (b), (c), or (e), 44906, 44912, 44935, 44936, or 44938(b)(3) of this title to another department, agency, or instrumentality of the United States Government.
