49 U.S.C. § 46315 — Lighting violations involving transporting controlled substances by aircraft not providing air transportation

(a) Application. This section only applies to aircraft that are not used to provide air transportation.

(b) Criminal Penalty. A person is fined under title 18, imprisoned up to 5 years, or both, if (1) they knowingly and willfully operate an aircraft in violation of an FAA rule or requirement on showing navigation or anti-collision lights; (2) they are knowingly transporting a controlled substance by aircraft, or helping such transport; and (3) that transporting or helping (A) is punishable by death or more than a year in prison under federal or state law, or (B) relates to an act punishable that way under a drug law, other than a law about simple possession.
