49 U.S.C. § 46316 — General criminal penalty when specific penalty not provided

submitted 32 years ago by Pub. L. 103-272 to r/title-49-TRANSPORTATION · 185 words · no verdicts yet

in plain englishAI-generated · not legal advice

This is a catch-all penalty for aviation rules with no specific punishment listed elsewhere. Knowingly and willfully breaking such a rule means a fine under title 18. Some chapters are excluded because they already have their own penalties.

(a) Criminal Penalty. Except as (b) provides, when this chapter does not already provide a specific criminal penalty, a person who knowingly and willfully violates this part, a rule or order issued by the Secretary of Transportation (or TSA or FAA, as applicable) under this part, or a certificate or permit term issued under section 41102, 41103, or 41302, is fined under title 18. Each day the violation continues counts as a separate violation.

(b) Nonapplication. Subsection (a) does not apply to chapter 401 (except sections 40103(a) and (d), 40105, 40116, and 40117), chapter 441 (except section 44109), chapter 445, chapter 447 (except section 44718(a)), or chapter 449 (except sections 44902, 44903(d), 44904, and 44907 through 44909).
