Lying to defraud the government about an airport project brings fines and up to 5 years in jail. This includes lying about materials, costs, or work on a grant-funded project. It also covers false claims for payment and false statements in required reports.
This section makes it a crime to lie to defraud the government in connection with an airport grant under this subchapter. A person — including a government or public-agency officer, agent, or employee — who knowingly makes a false statement with intent to defraud the government can be fined under Title 18, imprisoned for up to 5 years, or both.
The false statement can be any of three things:
(1) A false statement about the kind, amount, quality, or cost of materials or work — used or planned — in a plan, map, specification, contract, or cost estimate submitted with a grant application to the Secretary of Transportation for approval under this subchapter.
(2) A false statement or claim for work or materials tied to a project that is part of a grant application the Secretary has already approved under this subchapter.
(3) A false statement in any report or certification that this subchapter requires.
A person (including an officer, agent, or employee of the United States Government or a public agency) shall be fined under title 18, imprisoned for not more than 5 years, or both, if the person, with intent to defraud the Government, knowingly makes—
a false statement about the kind, quantity, quality, or cost of the material used or to be used, or the quantity, quality, or cost of work performed or to be performed, in connection with the submission of a plan, map, specification, contract, or estimate of project cost for a project included in a grant application submitted to the Secretary of Transportation for approval under this subchapter;
a false statement or claim for work or material for a project included in a grant application approved by the Secretary under this subchapter; or
a false statement in a report or certification required under this subchapter.
