The Administrator of General Services sets most regulations for this subchapter and must allow hardship waivers for remote or isolated relocations. Treasury consultation is required for tax rules, and Defense sets rules for Postal Service transfers.
(a)(1) Unless this subchapter specifically says otherwise, the Administrator of General Services must issue regulations needed to administer it. (2) The regulations must let an agency head or designee waive a limitation in this subchapter or its regulations for an employee moving to or from a remote or isolated location who would suffer hardship without the waiver. A waiver under this authority works despite any other provision of this subchapter.
(b) When writing rules for section 5724b, the Administrator must consult the Treasury Secretary.
(c) The Defense Secretary must issue regulations needed to implement section 5735.
Except as specifically provided in this subchapter, the Administrator of General Services shall prescribe regulations necessary for the administration of this subchapter.
The Administrator of General Services shall include in the regulations authority for the head of an agency or his designee to waive any limitation of this subchapter or in any implementing regulation for any employee relocating to or from a remote or isolated location who would suffer hardship if the limitation were not waived. A waiver of a limitation under authority provided in the regulations pursuant to this paragraph shall be effective notwithstanding any other provision of this subchapter.
In prescribing regulations for the implementation of section 5724b of this title, the Administrator of General Services shall consult with the Secretary of the Treasury.
The Secretary of Defense shall prescribe regulations necessary for the implementation of section 5735 of this title.
