submitted 16 years ago by Pub. L. 111-292 to r/title-5-GOVERNMENT-ORGANIZATION-AND-EMPLOYEES · 528 words · no verdicts yet
This section addresses executive agencies telework requirement. It sets the rules stated in the section.
(a) Telework eligibility. (1) Within 180 days after this chapter was enacted, each executive-agency head had to establish a policy allowing eligible employees to be authorized to telework, decide every employee's eligibility, and notify employees. (2) An employee* cannot telework under the policy after official discipline for more than 5 days' unauthorized absence in a calendar year, or for violating ethics rules by viewing, downloading, or exchanging pornography, including child pornography, on a Government computer or while performing official duties. (b) Participation. The policy must protect employee performance and agency operations; require a written, mandatory agreement between the manager and employee describing the arrangement; bar authorization when the employee does not follow the agreement; generally exclude daily duties requiring direct handling of secure material the agency head finds unsuitable for telework or on-site work that cannot be done remotely or elsewhere; include telework in continuity-of-operations plans; and list when temporary work from approved overseas locations is allowed. Except in an agency-head-determined emergency, those overseas circumstances cannot include duties requiring at least monthly direct handling of unsuitable secure material. (c) Required telework. If an agency places an employee on investigative leave under section 6329b, it may require similar duties by telework only if it decides this will not threaten anyone, destroy investigation evidence, lose or damage Government property, or otherwise harm legitimate Government interests; the employee is eligible under (a) and (b); and telework is appropriate.
Not later than 180 days after the date of enactment of this chapter, the head of each executive agency* shall—
establish a policy under which eligible employees of the agency may be authorized to telework;
determine the eligibility for all employees of the agency to participate in telework; and
notify all employees of the agency of their eligibility to telework.
An employee* may not telework under a policy established under this section if—
the employee has been officially disciplined for being absent without permission for more than 5 days in any calendar year; or
the employee has been officially disciplined for violations of subpart G of the Standards of Ethical Conduct for Employees of the Executive Branch for viewing, downloading, or exchanging pornography, including child pornography, on a Federal Government computer or while performing official Federal Government duties.
The policy described under subsection (a) shall—
ensure that telework does not diminish employee performance or agency operations;
require a written agreement that—
is entered into between an agency manager and an employee authorized to telework, that outlines the specific work arrangement that is agreed to; and
is mandatory in order for any employee to participate in telework;
provide that an employee may not be authorized to telework if the performance of that employee does not comply with the terms of the written agreement between the agency manager and that employee;
except in emergency situations as determined by the head of an agency, not apply to any employee of the agency whose official duties require on a daily basis (every work day)—
direct handling of secure materials determined to be inappropriate for telework by the agency head; or
on-site activity that cannot be handled remotely or at an alternate worksite;
be incorporated as part of the continuity of operations plans of the agency in the event of an emergency; and
enumerate the circumstances under which employees may be permitted to temporarily perform work requirements and duties from approved overseas locations, provided that, except in emergency situations as determined by the head of the agency, such circumstances shall not include a situation in which an employee’s official duties require on at least a monthly basis the direct handling of secure materials determined to be inappropriate for telework by the agency head.
If an agency places an employee in investigative leave under section 6329b, the agency may require the employee to, through telework, perform duties similar to the duties that the employee performs on-site if—
the agency determines that such a requirement would not—
pose a threat to the employee or others;
result in the destruction of evidence relevant to an investigation;
result in the loss of or damage to Government property; or
otherwise jeopardize legitimate Government interests;
the employee is eligible to telework under subsections (a) and (b) of this section; and
the agency determines that it would be appropriate for the employee to perform the duties of the employee through telework.
