This section defines "Native Hawaiian organization." A group qualifies if it represents Native Hawaiians and exists mainly to serve them. It must also show expertise in culturally significant preservation work. The Office of Hawaiian Affairs and Hui Malama I Na Kupuna O Hawai'i Nei automatically qualify.
(a) In general. This section defines "Native Hawaiian* organization" for this division. A group counts as a Native Hawaiian organization if it does all three of these things: (1) it serves and represents the interests of Native Hawaiians; (2) its main, stated purpose is providing services to Native Hawaiians; and (3) it has shown real expertise in the parts of historic preservation* that matter culturally to Native Hawaiians.
(b) Inclusions. The term "Native Hawaiian organization" always includes two specific groups: the Office of Hawaiian Affairs of Hawaii, and Hui Malama I Na Kupuna O Hawai'i Nei, a nonprofit incorporated under Hawaii state* law.
In this division, the term “Native Hawaiian* organization” means any organization that—
serves and represents the interests of Native Hawaiians;
has as a primary and stated purpose the provision of services to Native Hawaiians; and
has demonstrated expertise in aspects of historic preservation* that are culturally significant to Native Hawaiians.
In this division, the term “Native Hawaiian organization” includes the Office of Hawaiian Affairs of Hawaii and Hui Malama I Na Kupuna O Hawai’i Nei, an organization incorporated under the laws of the State* of Hawaii.
