54 U.S.C. § 304102 — Duties of Council

(a) Duties. The Council^* must (1) advise the President and Congress on historic preservation^* matters, recommend ways to coordinate Federal, State^*, and local agencies and private groups on historic preservation^*, and advise on sharing information about those activities; (2) work with the National Trust^* and appropriate private agencies to encourage public interest and participation in historic preservation; (3) recommend studies on things like (A) whether existing laws and regulations on State and local historic preservation activities are adequate, and (B) how tax policies at every level of government affect historic preservation; (4) advise on guidelines to help State and local governments draft historic preservation legislation; (5) work with appropriate public and private agencies and institutions to encourage training and education in historic preservation; (6) review Federal agencies' policies and programs and recommend ways they can better coordinate with, and stay consistent with, the policies and programs carried out under this division; and (7) inform and educate Federal agencies, State and local governments, Indian tribes, other nations and international organizations, and private groups and individuals about the Council's own authorized activities.

(b) Annual report. Each year, the Council must send the President a full report on its activities and the results of its studies, and may send extra or special reports whenever it thinks that is a good idea. Each report must propose legislation and other actions the Council thinks are necessary to carry out its recommendations, and must include the Council's assessment of current and emerging historic preservation problems and an evaluation of how well Federal agencies, State and local governments, and the private sector are carrying out this division.
