6 U.S.C. § 124m — Classified Information Advisory Officer

(a) Requirement to establish. The Secretary must identify and designate a Classified Information Advisory Officer within the Department. (b) Responsibilities. This officer has two jobs. First, developing and disseminating educational materials, and developing and running training programs, to help state, local, and tribal governments (including their law enforcement agencies) and private-sector entities in three ways: developing plans and policies to respond to requests related to classified information without communicating that information to people who lack appropriate security clearances; understanding the appropriate procedures for challenging classification designations on information their personnel receive; and learning the means by which their personnel may apply for security clearances. Second, informing the Under Secretary for Intelligence and Analysis about policies and procedures that could, as appropriate, help facilitate sharing classified information with that same personnel. (c) Initial designation. Not later than 90 days after October 7, 2010, the Secretary had to: designate the initial Classified Information Advisory Officer; and submit to the Senate Committee on Homeland Security and Governmental Affairs and the House Committee on Homeland Security a written notification of that designation.
