6 U.S.C. § 345 — Establishment of Officer for Civil Rights and Civil Liberties

(a) The Officer for Civil Rights and Civil Liberties reports directly to the Secretary and must: (1) review and assess reports of civil rights, civil liberties, and racial, ethnic, or religious profiling abuses by Department employees and officials; (2) publicize, through the internet, radio, television, or newspaper ads, information on what the Officer does and how to contact the Officer; (3) help the Secretary and every Department office develop, put in place, and regularly review policies and procedures that build civil rights and civil liberties protection into the Department's programs; (4) oversee compliance with constitutional, statutory, regulatory, policy, and other requirements protecting the civil rights and civil liberties of people affected by Department programs; (5) work with the Privacy Officer so that civil rights, civil liberties, and privacy issues are handled together, in one integrated way, and so Congress gets the reports it is owed about these programs and policies; and (6) investigate complaints and information about possible civil rights or civil liberties abuses, unless the Department's Inspector General decides to investigate that complaint instead. (b) Every year, the Secretary must send the President of the Senate, the Speaker of the House, and the relevant Congressional committees a report on how this section is being carried out, including how the money for it was spent, and details of any abuses under (a)(1) and what the Department did in response.
