6 U.S.C. § 452Reorganization

submitted 24 years ago by Pub. L. 107-296 to r/title-6-DOMESTIC-SECURITY · 130 words · no verdicts yet

in plain englishAI-generated · not legal advice

The Secretary can reorganize the Department by moving duties between officers or restructuring internal units. But this either needs to follow a separate reorganization law, or requires 60 days' notice to Congress first. The Secretary can't use this power to eliminate any office or program that another law requires.

(a) The Secretary may move duties between Department officers, and may create, combine, change, or shut down organizational units inside the Department — but only in two ways: (1) following the process set out in section 542(b), or (2) after giving the relevant congressional committees 60 days' notice that explains the reason for the change. (b) Limitations: (1) In general: The power in subsection (a)(1) cannot be used to eliminate any agency, unit, program, or function that this chapter creates or requires the Department to keep. (2) Abolitions: The power in subsection (a)(2) cannot be used to eliminate any agency, unit, program, or function that any statute creates or requires the Department to keep.
