6 U.S.C. § 453 — Use of appropriated funds

(a) Disposal of property: (1) Strict compliance: If a law specifically authorizes the Secretary to dispose of real property, the Secretary must exercise that authority in strict compliance with subchapter IV of chapter 5 of Title 40. (2) Deposit of proceeds: The Secretary must deposit any proceeds from selling property into the Treasury's miscellaneous receipts, as section 3302(b) of Title 31 requires. (b) Gifts: Except as allowed by section 2601 of Title 10, section 93 of Title 14, or sections 321n or 464 of this title, the Department may not accept, use, or dispose of gifts or donations of services or property — unless an appropriations act specifically permits it in advance, and then only under the conditions and for the purposes that act sets out. (c) Budget request: As section 1105 of Title 31 requires, the President must send Congress a detailed budget request for the Department for fiscal year 2004, and for every fiscal year after that.
