7 U.S.C. § 136e — Registration of establishments

(a) Requirement. No one may produce a pesticide covered by this law, or an active ingredient used to make one, in any state unless the place where it's made — the "establishment" — is registered with the EPA. The registration application must include the establishment's name and address, and the name and address of the producer running it. (b) Registration. When EPA gets an application under (a), it registers the establishment and gives it an establishment number. (c) Information required. (1) Within 30 days of being registered, a producer must tell EPA the types and amounts of pesticides (and active ingredients, if applicable) it is currently producing, produced in the past year, and sold or distributed in the past year. This information must be kept current and resubmitted every year, following EPA's rules. (2) If EPA is issuing a stop-sale order under section 136k, it can require the producer to identify who received a pesticide from that establishment. (d) Confidential records and information. Information submitted under (c) is treated as confidential and protected under section 136h — except for the names of the pesticides or active ingredients themselves, which are not confidential.
