7 U.S.C. § 228b–4Violation of final order by live poultry dealer; penalty

A live poultry dealer, or its officers or employees, who disobeys a final Secretary's order can be fined between $1,000 and $20,000 upon conviction. This applies once appeals are over or the deadline to appeal has passed. Each day the disobedience continues counts as a separate crime.

If a live poultry dealer — or an officer, director, agent, or employee of one — fails to obey an order the Secretary issued under section 228b-2, that person can be fined between $1,000 and $20,000 upon conviction. This applies in three situations: (1) once the time to file an appeal with the court of appeals has run out and no appeal was filed; (2) once the time to ask the Supreme Court to review the case has run out, if the court of appeals upheld the order and no one asked the Supreme Court to review it; or (3) once the courts have already upheld the order under section 228b-3. Each day the person keeps disobeying counts as its own separate crime, so fines can add up quickly.
