7 U.S.C. § 7441 — Findings and declaration of policy

(a) Findings: Congress finds that: (1) canola^* and rapeseed^* products are important and nutritious parts of the human diet; (2) producing them plays an important role in the United States^* economy because (A) thousands of producers produce them and many processing entities process them, and (B) products produced in the United States are consumed throughout the United States and foreign countries; (3) canola, rapeseed, and their products should be readily available and efficiently marketed so consumers have an adequate supply at a reasonable price; (4) maintaining and expanding existing markets and developing new markets for them is vital to producers, processors, marketers, and the United States economy, and is necessary for their ready availability and efficient marketing^*; (5) established State^* and national organizations conduct valuable research^*, promotion^*, and consumer-education programs; (6) cooperatively developing, financing, and carrying out a coordinated national program of research, promotion, consumer information^*, and industry information^* is necessary to maintain and expand existing markets and develop new markets and uses; and (7) these goods move in interstate and foreign commerce^*, and goods that do not move in interstate or foreign commerce directly burden or affect interstate commerce in them.

(b) Policy: The policy of this subchapter is to establish an orderly process for developing, financing through assessments on domestically produced canola and rapeseed, and carrying out a program of research, promotion, consumer information, and industry information. The program is designed to strengthen the canola and rapeseed industry’s marketplace position, maintain and expand existing domestic and foreign markets and uses, and develop new markets and uses.

(c) Construction: Nothing in this subchapter controls production or otherwise limits an individual producer’s right to produce canola, rapeseed, or their products.
