7 U.S.C. § 7471 — Suspension or termination

The Secretary must suspend or end a marketing order if it blocks the law's goals. This applies to the whole order or just one part of it. Suspending or ending an order does not itself count as an order.
(a) In general: If the Secretary* decides that an order* issued under section 7463 - or any part of that order - is getting in the way of, or failing to support, the purposes of this subchapter, the Secretary must suspend or end that order or that part of it.
(b) Limitation: When the Secretary suspends or ends an order (or part of one) this way, that act is not itself treated as an "order" under this subchapter.
If the Secretary* finds that an order* issued under section 7463 of this title, or a provision of the order, obstructs or does not tend to effectuate the purposes of this subchapter, the Secretary shall suspend or terminate the operation of the order or provision.
The suspension or termination of any order, or any provision of an order, shall not be considered an order under this subchapter.
