7 U.S.C. § 7613 — Relevance and merit of agricultural research, extension, and education funded by the Department
submitted 28 years ago by Pub. L. 105-185 to r/title-7-AGRICULTURE · 659 words · no verdicts yet
This law requires scientific peer review of agricultural research grants, and separate reviews of how relevant and worthwhile the Department's research, extension, and education activities are. Universities receiving certain funds must run their own merit-review process too.
(a) Reviewing the National Institute of Food and Agriculture.
(1) Peer review of grants. The Secretary must set up scientific peer review for every competitively awarded agricultural research grant from the National Institute of Food and Agriculture.
(2) Relevance and merit review. The Secretary must also set up review procedures — covering both relevance and merit — for every competitively awarded research, extension, or education grant from the Institute, and must keep consulting the Advisory Board while designing these merit-review procedures.
(3) These peer and merit reviews cannot take into account whether matching funds are offered or available.
(b) Advisory Board review. Each year, the Advisory Board must review how relevant the Department's research, extension, and education funding is to the priorities set under section 7612(a), and whether that funding is adequate.
(c) Requests for proposals. After the yearly review under (b), the Secretary must factor its results into writing and evaluating requests for proposals for competitively funded research, extension, or education work. While writing each year's request for proposals, the Secretary must also ask for and consider input from people who do or use this work, about the prior year's request.
(d) Scientific peer review of research.
(1) The Secretary must set up procedures ensuring scientific peer review of all Department research activities.
(2) At least once every 5 years, a review panel must confirm that each Department research activity and program has scientific merit and relevance.
(3) For research in the Department's research, education, and economics mission area, the review panel must weigh the work's scientific merit and relevance to the priorities set under section 7612, and its significance on a national or multi-state level.
(4) The review panel must be made up of scientific experts, and most of them must not work for the agency whose research is being reviewed. Wherever practical, the Secretary must use college and university scientists on these panels.
(5) The panel's results must go to the Advisory Board.
(e) Merit review by universities.
(1) Starting October 1, 1999, each 1862 and 1890 Institution must set up and follow its own merit-review process for an activity, in order to remain eligible for agricultural research or extension funds.
(2) Starting the same date, each 1994 Institution must do the same to remain eligible for agricultural extension funds.
(3) Each Hispanic-serving agricultural college and university must also set up and follow its own merit-review process, to remain eligible for agricultural extension funds.
The Secretary shall establish procedures that provide for scientific peer review of each agricultural research grant administered, on a competitive basis, by the National Institute of Food and Agriculture of the Department.
The Secretary shall establish procedures that provide for relevance and merit review of each agricultural research, extension, or education grant administered, on a competitive basis, by the National Institute of Food and Agriculture.
The Secretary shall consult with the Advisory Board in establishing the merit review procedures on a continuous basis.
Peer and merit review procedures established under paragraphs (1) and (2) shall not take the offer or availability of matching funds into consideration.
On an annual basis, the Advisory Board shall review—
the relevance to the priorities established under section 7612(a) of this title of the funding of all agricultural research, extension, or education activities conducted or funded by the Department; and
the adequacy of the funding.
As soon as practicable after the review is conducted under subsection (b) for a fiscal year, the Secretary shall consider the results of the review when formulating each request for proposals, and evaluating proposals, involving an agricultural research, extension, or education activity funded, on a competitive basis, by the Department.
In formulating a request for proposals described in paragraph (1) for a fiscal year, the Secretary shall solicit and consider input from persons who conduct or use agricultural research, extension, or education regarding the prior year’s request for proposals.
The Secretary shall establish procedures that ensure scientific peer review of all research activities conducted by the Department.
As part of the procedures established under paragraph (1), a review panel shall verify, at least once every 5 years, that each research activity of the Department and research conducted under each research program of the Department has scientific merit and relevance.
If the research activity or program to be reviewed is included in the research, educational, and economics mission area of the Department, the review panel shall consider—
the scientific merit and relevance of the activity or research in light of the priorities established pursuant to section 7612 of this title; and
the national or multistate significance of the activity or research.
A review panel shall be composed of individuals with scientific expertise, a majority of whom are not employees of the agency whose research is being reviewed.
To the maximum extent practicable, the Secretary shall use scientists from colleges and universities to serve on the review panels.
The results of the panel reviews shall be submitted to the Advisory Board.
Effective October 1, 1999, to be eligible to obtain agricultural research or extension funds from the Secretary for an activity, each 1862 Institution and 1890 Institution shall—
establish a process for merit review of the activity; and
review the activity in accordance with the process.
